Abstract
in recent years, the Federal Supreme Court of Iraq has assumed an increasingly significant role in adjudicating complex constitutional disputes, particularly those concerning the relationship between the Federal Government and the Kurdistan Region.
The Court has emerged as a central actor in interpreting and enforcing constitutional provisions in matters of national significance. Notably, it has rendered several landmark decisions that directly affect the Kurdistan Region, including the ruling on the unconstitutionality of the Kurdistan Oil and Gas Law , the dissolution of the Kurdistan Parliament and the Region’s Provincial Councils, as well as verdicts regarding the disbursement of public sector salaries within the Region. These decisions, however, have generated considerable legal and political controversy, both within the Region and at the national level.
This study aims to provide a comprehensive analysis of the legal and political implications of the Federal Supreme Court’s decisions related to the Kurdistan Region. Through critical examination of the Court’s jurisprudence, the study concludes that certain rulings—such as the dissolution of the Kurdistan Parliament—lack constitutional validity, while others may be grounded within the existing constitutional framework.
Based on these findings, the study advances several policy recommendations. These include: the expedited formation of the tenth cabinet of the Kurdistan Regional Government; the prevention of power centralization within the executive authority; the timely conduct of elections for the Region’s Provincial Councils; the institutionalization of public salary disbursements through federally recognized banking mechanisms; and the promotion of a transparent and accountable political discourse among the Kurdish political parties.

دادگای باڵای فیدراڵی عێراق لەم چەند ساڵەی دوایدا رۆڵێکی گرنگ دەگێڕێت لە یەکلایکردنەوەی زۆرێک لەو پرسە دەستورییانەی دەخرێنە بەردەستی. ئەوەی تایبەت بەهەرێمی کوردستان: دادگاکە رۆڵی سەرەکی بینیوە لەچارەسەرکردنی هەندێک لەو دۆسییە گرنگانەی کە لەنێوان حکومەتی عێراقی فیدراڵ وهەرێمی کوردستان هەبوون، لەوانە بڕیاردان لەسەر نادەستوری بوونی یاسای یاسای ژمارە (٢٢) ساڵی (٢٠٠٧) نەوت و غازی هەرێمی کوردستان، هەڵوەشاندنەوەی پەرلەمانی کوردستان و ئەنجومەنی پارێزگاکانی هەرێم لەگەڵ بڕیاری چارەسەرکردنی مووچەی مووچەخۆرانی هەرێم، بەڵام لەگەڵ ئەوەشدا بڕیارەکانی دادگای فیدراڵی زۆرێک مشتومڕی یاسایی و سیاسی بەدوای خۆیدا هێنا.
ئەم توێژینەوە هەوڵێکە بۆ باسکردن و لێکدانەوەی لێکەوتەکانی ئەو بڕیارانە لەسەر هەرێمی کوردستان، دەرخستنی لایەنە یاسایی وسیاسییەکانی. توێژینەوەکە بەچەند ئەنجامێکی گرنگ گەیشتووە وەک نادەستوری بوونی هەڵوەشاندنەوەی پەرلەمانی کوردستان ودەستوریبوونی بڕیارەکانی دیکەی. لەهەمان کاتیشدا توژینەوەکە چەند راسپارەدەیەکی خستوەتەروو وەک زوو پێکهانانی کابینەی دەیەمی حکومەتی هەرێمی کوردستان و نەهێشتنی هەژموونی دەسەڵاتی جێبەجێکردن، ئەنجامدانی خێرایی هەڵبژاردنی ئەنجومەنی پارێزگاکانی بە بانکی کردنی (توطین) کردنی موچەی مووچەخۆرانی هەرێمی کوردستان لەو بانکە فیدراڵییانەی کە باوەڕپێکراون، لەگەڵ گەڵاڵەکردنی گوتارێکی سیاسی کوردی شەفاف و راستگۆ لەنێوان هێزە سیاسییەکانی هەرێم و داڕشتنی سیاسەتێکی دروستی ئەوتۆ کە لەناو چوارچێوەی دەستوری عێراقیدا گەرەتی مافە رەواکانی گەلی کوردستان بکات.
